This situation is a perfect example of an ethical dilemma because when a contract does not arrive for some individuals, it places both the provider and individuals with intellectual disabilities in a sticky situation. Given that there is no contract for the individual, the provider has the option to either not provide service or provide services and not receive retroactive reimbursement from the state. Thus, putting providers in a position of possible financial strain if they render services with no reimbursement. However, these vulnerable populations cannot be left without care. It leads to the question of who will be held liable if something happens to an individual with an intellectual disability because providers did not receive a contract that month for the individual? States do not have a legal obligation to provide or contract services and the state does not have an obligation to provide support when there is no fundamental right involved. But ethically, this issue cannot be ignored as a vulnerable population is at risk. There are some non-legal steps to help resolve this including: Interest and advocacy groups can advocate for individuals with intellectual disabilities, encouraging change and action. Interest groups play a major role in influencing policymakers (Wilensky & Teitelbaum, 2023). Explore the option of donations or volunteers to cover care in the meantime. Get staff members, families, volunteers, and others involved in problem solving. Working as a team can help develop and recognize more probable solutions. Providing services without having a contract puts providers at financial risk. However, not providing care for this population poses an even bigger risk. As healthcare providers we are to support our patients and advocate for them. Especially in this situation given the involvement of a vulnerable population, advocacy is crucial. In the meantime, until the situation reaches a solution, I would advocate that care be provided regardless of reimbursement status.
